DECISION & ORDER Appeal by the defendant from a judgment of the Supreme Court, Queens County (Demakos, J.), rendered January 14, 1992, convicting him of arson in the fourth degree, reckless endangerment in the second degree, and assault in the third degree, upon a jury verdict, and imposing sentence. Ordered that the judgment is modified, on the law, by reversing the conviction of arson in the fourth degree, vacating the sentence imposed thereon, and dismissing that count of the indictment; as so modified, the judgment is affirmed.
